The agreement
These Terms govern your use of MadCoolSocial, a service operated by MadCool LLC ("we", "our", "us"). By creating an account or using the service you agree to these Terms.
What we provide
MadCoolSocial drafts, schedules, and (with your authorization) publishes social media posts to platforms you connect to your account. You authorize us to act on your behalf for the specific actions covered by the OAuth scopes you grant during platform connection.
Your responsibilities
- You are responsible for the accuracy of the brand profile and source material you provide.
- You are responsible for what gets published — even posts that ship via autopilot mode are published in your name, on your authorization.
- You will not use the service to publish content that violates the policies of the social platforms you have connected, or that is unlawful, defamatory, infringing, or harmful.
- You will keep your account credentials secure. You are responsible for activity on your account.
Pricing and billing
Subscription fees are billed in advance on a recurring basis. You can cancel at any time; cancellations take effect at the end of the current billing period. We do not prorate refunds for partial months. Specific plan pricing is on our pricing page.
Service availability
We aim for high uptime but do not guarantee uninterrupted service. Scheduled maintenance, third-party platform outages, and rate limits imposed by connected platforms can affect publishing. We are not liable for missed posts caused by third-party platform issues.
Termination
Either party may terminate this agreement at any time. We may suspend or terminate accounts that violate these Terms or that pose a risk to the service or other users. On termination we will stop publishing on your behalf and, at your request, delete your account data within a reasonable timeframe.
Disclaimer and limitation of liability
The service is provided "as is" without warranty of any kind. To the maximum extent permitted by law, our aggregate liability arising from or related to your use of the service is limited to the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim.
Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
